Terms of Service

1. Acceptance of Terms

By accessing or using the website at angermanagement785.com (the "Site") or any service offered through the Site, including the online booking system, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Site.

2. About Us

The Site and the related smash room service are operated by Anger Management 785, LLC, a Kansas limited liability company, located at 921 N. Kansas Ave., Topeka, KS 66608 ("we," "us," or "AM785"). You may contact us at office@angermanagement785.com.

3. Services Offered

AM785 operates a smash room, splat (paint) room, and private party room located at the address above. Through the Site, customers may:

• View pricing, services, and operating information for AM785.
• Book sessions in the smash room, splat room, or party room.
• Pay for sessions through our payment processor (Stripe).
• Sign the AM785 Release of Liability waiver as required prior to participation.

The Site is not a substitute for in-person service. Physical participation in AM785 activities is governed by the separate Release of Liability waiver presented at or before participation.

4. Booking, Payment, and Cancellation

4.1 Booking

Bookings made through the Site are subject to availability and, for certain group sizes and the private party room, to manual confirmation by AM785 before the booking is final.

4.2 Payment

• For standard bookings, payment is collected in full at the time of booking.
• For party bookings of 8 or more attendees, or any booking that uses the private party room, a $100 deposit is collected at booking. The remaining balance is collected at the event or via a follow-up invoice from AM785.
• All payments are processed through Stripe. AM785 does not store full card numbers on its own systems.

4.3 Cancellation and refund policy

• A customer who cancels or reschedules at least 24 hours before the scheduled booking time will receive a full refund or may reschedule without penalty.
• A customer who cancels within 24 hours of the scheduled booking time may reschedule, but is not entitled to a refund.
• A customer who does not show up for a booking and does not contact AM785 forfeits the full amount paid for that booking.

4.4 Promotional codes

AM785 may offer promotional codes from time to time. Each code's terms (validity period, products eligible, redemption limits) are set at the time of issuance and may not be combined unless we specifically allow it.

5. Waiver of Liability (Mandatory for Participation)

Every attendee at AM785 must sign the AM785 Release of Liability waiver before participating in a smash room, splat room, or party room session. The waiver is delivered to attendees by email at the time of booking. The booking is contingent on each attendee signing the waiver; AM785 reserves the right to refuse service to any attendee who has not signed.

The waiver includes a Media Release section in which each attendee may consent to or decline the use of their image, video, or audio in AM785's marketing materials. Customers who decline media use will not appear in any photo, video, or audio published by AM785 on this Site or elsewhere.

Minors: the Media Release does not grant consent for the use of images, video, or audio of minors. AM785 does not publish any photo, video, or audio containing a minor on this Site or in any other marketing surface.

6. Eligibility and Conduct

You agree that:

• You are at least 18 years of age, or are using the Site with the supervision and consent of a parent or legal guardian.
• The information you provide during booking is accurate and complete.
• You will not use the Site to commit fraud, harass other customers or AM785 staff, or interfere with the operation of the Site.
• You will follow all posted rules at AM785's physical location, as detailed in the Release of Liability waiver.

We reserve the right to refuse service, cancel a booking, or restrict access to the Site for any user whose conduct we determine, in our sole reasonable discretion, threatens the safety of attendees or staff or the integrity of the Site.

7. Intellectual Property

All content on the Site, including text, graphics, photographs, logos, the AM785 name and marks, and the underlying software, is owned by AM785 or our licensors and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any content on the Site without our prior written permission, except that you may save or print a copy of a booking confirmation for your personal records.

8. Photos and Media

By visiting AM785's physical location, you may be photographed or recorded. The Release of Liability waiver governs whether AM785 may use that imagery in marketing materials. The Site is one of those marketing surfaces. See the waiver for the full Media Release terms.

9. Third-Party Services and Links

The Site uses third-party services, including but not limited to Stripe (payments), Google (Calendar integration, Business Profile, Analytics), and Cloudflare (hosting, DNS, security). Your use of those services is governed by their respective terms of service and privacy policies. The Site may link to third-party websites; we are not responsible for the content or practices of those sites.

10. Disclaimers

THE SITE AND THE SERVICES OFFERED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY KANSAS LAW, AM785 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

The smash room and related activities offered at AM785's physical location involve inherent physical risk. THE RELEASE OF LIABILITY WAIVER, NOT THESE TERMS, GOVERNS THE LEGAL RELATIONSHIP BETWEEN AM785 AND CUSTOMERS WITH RESPECT TO PHYSICAL PARTICIPATION IN AM785 ACTIVITIES.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY KANSAS LAW, AM785'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID AM785 IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100. AM785 IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless AM785 and its officers, employees, agents, and affiliates from and against any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or third-party right.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or your use of the Site will be resolved as follows:

• The parties will first attempt to resolve the dispute through good-faith negotiation.
• If negotiation does not resolve the dispute within 30 days, the dispute will be submitted to binding arbitration under the rules of the American Arbitration Association. The arbitrator's decision is final. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

You waive any right to participate in a class action arising out of or relating to these Terms.

14. Modifications

We may modify these Terms from time to time. The current version is always posted on this page with an updated Effective Date at the top. Continued use of the Site after a modification constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.
